By accessing or using Cirklr, you agree to be bound by these Terms of Use. If you do not agree with these terms, you may not use the platform.

1. Purpose of Cirklr

Cirklr is a community-based platform that enables users to share items within trusted circles such as neighborhoods, housing associations, or other local groups. Cirklr provides the technical infrastructure only and does not participate in the lending, borrowing, transportation, storage, or use of any item.

2. Role and Responsibility of Cirklr

Cirklr acts solely as a neutral intermediary.

Cirklr does not own, inspect, verify, maintain, or insure any items listed.

Cirklr does not guarantee:

  • The condition, safety, legality, or functionality of any item.
  • The accuracy of item descriptions or user-provided information.
  • That borrowed items will be returned.

All transactions and interactions occur entirely at users' own risk.

3. User Responsibilities

By using Cirklr, you agree to:

  • Act honestly, respectfully, and in good faith toward other users.
  • Only list items that are safe, functional, and legal to share.
  • Handle items with reasonable care when borrowing.
  • Communicate clearly regarding pickup, return, and usage conditions.
  • Resolve any disagreements directly with the other user.

4. Disputes Between Users

Cirklr does not intervene in disputes between users, including but not limited to:

  • Damaged or broken items
  • Late or non-returned items
  • Misunderstandings about usage or condition

Users are solely responsible for resolving such disputes privately.

5. Limitation of Liability

To the maximum extent permitted by Swedish law:

  • Cirklr shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the platform.
  • Users assume full responsibility for their actions, communications, and transactions.
  • Cirklr accepts no liability for loss, damage, injury, or financial loss resulting from shared items.

6. Platform Usage and Moderation

Cirklr reserves the right to:

  • Remove listings or content that violate these Terms or community rules.
  • Suspend or terminate accounts associated with misuse, fraud, or harmful behavior.
  • Modify platform features when necessary.
  • Update these Terms when legally or operationally required.

Use of Cirklr for commercial purposes is strictly prohibited without written permission.

7. User Eligibility

  • Users must be at least 18 years old.
  • Businesses, organizations, or professional rental services may not use the platform without prior written approval.
  • Users must provide accurate account information and keep it up to date.

8. Prohibited Activities

Users may not:

  • Share illegal, dangerous, or unsafe items.
  • Misrepresent the condition or availability of an item.
  • Use the platform for sales, rentals, or commercial activity.
  • Harass, threaten, or deceive other users.
  • Attempt to bypass platform limits or premium restrictions.

9. Ownership of Content

Users retain ownership of all content they upload (photos, descriptions, messages).

By submitting content, users grant Cirklr a non-exclusive right to display it solely for operating the platform.

Cirklr does not use content or personal data for advertising or marketing purposes.

10. Account Termination

Cirklr may suspend or terminate accounts without compensation if:

  • These Terms are violated.
  • Harmful, deceptive, or illegal behavior is reported and verified.
  • Platform integrity is threatened.

Users may request account deletion at any time.

11. Premium Membership

  • Some features may require a symbolic premium fee (e.g., for participation in large circles).
  • Premium is optional.
  • Users may cancel at any time.
  • Payment does not transfer ownership or insurance coverage for items.
  • Premium does not change user liability.

12. Data Collection

Cirklr collects only the data required for platform operation:

Account Information:

  • Email address
  • Username
  • Encrypted password

Optional Profile Information:

  • Profile picture
  • Location or neighborhood

Platform Usage Data:

  • Items listed or borrowed
  • Messages
  • Request status history
  • Login activity

Technical Data:

  • IP address
  • Browser type and operating system

Cirklr does not track browsing behavior for marketing or advertising purposes.

13. Data Privacy & Security

  • All user data is handled according to Cirklr's Privacy Policy.
  • Data is encrypted in transit and at rest.
  • Only authorized administrators have system access.
  • No personal data is sold or shared with advertisers.
  • Cookies are used only for login/session functionality.

14. Compliance with Swedish & EU Law

Cirklr operates under:

  • Swedish consumer protection law
  • GDPR (EU General Data Protection Regulation)
  • Applicable IT and privacy regulations in Sweden

Nothing in these Terms limits any mandatory consumer rights.

15. Indemnification

Users agree to indemnify and hold Cirklr harmless from:

  • Claims
  • Damages
  • Legal disputes
  • Financial losses

resulting from their own actions, content, or interactions on the platform.

16. Governing Law & Jurisdiction

These Terms are governed by Swedish law.

Any legal disputes shall be handled by the courts of Sweden.

17. Disclaimer of Warranties

Cirklr is provided “as is” and “as available.”

We make no warranties regarding uptime, performance, reliability, or availability.

18. Feedback and Suggestions

Any feedback sent to Cirklr may be used freely without compensation or obligation. Feedback does not create ownership rights.

19. Changes to These Terms

Cirklr may update these Terms when required. Users will be notified via email or in-platform messages for significant changes.
